The environment is becoming one of the main focuses of today's society. A large number of companies have understood this and have incorporated sustainability in their mission statement and working structure. Many corporations, although striving for sustainability, have however become the focus point of environmentalists and NGO's. Climate change litigation against both companies and states will only rise in numbers, extent and scope in the following years. Investments do and will increasingly depend on the way a company is handling social and environmental issues. Taking a strong position can benefit the company as it is seen that long-term objectives over short term profit will make for a stronger company in the long haul. Environmental, Social and Governance (ESG) criteria are one way to monitor the social consciousness of a company and the legal team has a big role to play in implementing these or alike policies and thereby reshaping and preparing the company for a sustainable future.
