21. EU Competition Law in the digital era: Shield from (over?) enforcement of authorities & Sword to claim integrity or damages from third parties

Over the past decades, markets have changed significantly. In particular, the digitalisation of the economy has profoundly transformed consumer behaviour and how markets operate. This session will take a look at how the EU competition authorities have responded to this challenging digital era and the new players that have emerged. it will also look at how companies can protect themselves from being seen as dominant. Lastly, there will be a discussion on recovering damages in cartel cases: Many companies have likely suffered damages due to a cartel being formed and the resulting higher market prices, but the path in court to claim damages remains difficult to navigate.
